How much are Creek Hollow’s HOA dues?

Homeowner dues are $404.80/year, paid biannually to our management company, SpectrumAM (877-342-6233).

Is there an HOA transfer fee when I buy a new property in Creek Hollow?

Yes, there is, and the amount of the fee varies by property. Ask your realtor for details.

Is membership in the Homeowners’ Association optional?

No. Any person who becomes an owner in the Creek Hollow Estates Homeowners’ Association is automatically a Member. Membership is mandatory, and ceases only when the person ceases to own property. Every Member is subject to the rights and requirements of the governing documents.

Who do I contact regarding my account?

If you need to inquire about your account, you may contact SpectrumAM Homeowner Service Department at 972-992-3444. They will be able to assist you with any questions you may have regarding the HOA or your account balance.

I’ve fallen behind on my dues what can I do?

If you need help regarding your dues, please contact our Association Management company immediately at 972-992-3444 and request a Payment Plan.

What types of use rules might affect my home?

The HOA’s governing documents contain rules relating to pets, satellite dishes, clotheslines, fences, parking, home businesses, rental of homes, and other issues. You should carefully read the governing documents to understand the nature of these restrictions and fill out the ARC form for approval before building.

Can the Homeowners Association restrict the types of improvements I can make to my home?

The governing documents require that you submit plans and specifications for approval before you make any changes to the exterior or build any additions or other structures. Please fill out the ARC form for approval.

Where are the Homeowner restrictions in Creek Hollow Homeowners Association (HOA) documented?

When the HOA was originally setup by Highland Homes, the Creek Hollow Developer, the Declaration of Covenants, Conditions and Restrictions was written for the initial phases of the neighborhood to document the HOA terms. It was amended by the same Developer as the newer phases were added. This is a legal document and defines the conditions and restrictions to be followed by the homeowners that reside within the HOA. What are the requirements for homeowners in order to make changes to their homes?

Section 5.2 of the Covenants explain the responsibility of the homeowner to submit plans for changes to the Architectural Committee.

5.2 Submission of Plans to Architectural Control Committee. No building, fence, wall, parking area, swimming pool, spa, pole, mail box, driveway, fountain, pond, tennis court, sign, exterior color or shape, or new or modification of a structure shall be commenced, erected or maintained upon any Lot or the patio or garage used in connection with any Lot after the purchase of any Lot from Declarant, nor shall any exterior addition to or change or alteration therein be made until the plans and specifications showing the nature, kind, shape, height, materials and location of the same are submitted to and approved by the Committee. Plans and specification shall be submitted to the Committee at least fourteen (14) days prior to the commencement of any construction or modification. The following shall be submitted for approval: a site plan showing the entire Lot with existing improvements, and floor plan and elevations of all faces of the proposed structure; and a description of all exterior construction materials.

What is the Architecture Committee and their purpose?

The purpose of the Architecture Committee is to ensure property changes being made by homeowners remain in compliance with the conditions and restrictions outlined in the covenants. This is why any changes to the exterior of the home needs to be preceded by an Architectural Request form. This allows the Architecture Committee to review the changes against the Covenants to ensure changes being made remain in compliance to avoid the homeowner receiving a Notice of Non-Compliance at a later time. They will let the homeowners know where certain changes may be out of compliance and what can be done to remain in compliance.

What is an ARC Request and how is it processed?

An ARC or Modification Request is a request to make any changes to the exterior of your home. This is enforceable by the HOA in order to assure your property will hold its value. The HOA will submit your request to the Committee for review. The Committee has 14 days to approve or deny your request. You may fill out the ARC form here.

How do I know if my project requires a permit from the City?

Common residential improvements requiring a permit include, but are not limited to swimming pools, storage buildings, sunrooms, gazebos, patio covers, pergolas, awnings, flag poles, etc. To get more specific information on requirements for your project, contact the City of Richardson.

What is the proper way to report a violation of the association rules?

All homeowners can contact SpectrumAM with any violation concerns. The violation process is a Friendly Reminder (2 weeks until next notice) is sent and then a TROPA letter. The TROPA letter is required by the State of Texas and the HOA must allow the homeowner 30 days to correct the violation or appeal their violation to the board before the association can go on property. Once the 30 days has expired the association can then correct the violation at the homeowner’s expense. During the violation process if the homeowner corrects the violation in the allotted time the violation is closed, and the violation process starts again. This may seem like a long process, but the State of Texas Laws are in place to protect the homeowners and the Association alike.

What types of things are looked at when inspections are performed?

Violations are issued for lawn maintenance, flower beds, dead trees and shrubs, trash cans, unapproved ARC installations, damaged fencing, etc.

What should I do about barking dogs, lost pets, and stray animals?

Reach out and speak to your neighbor regarding their barking dogs if you can. Always try the neighborly approach first. The Nextdoor app is the easiest way to notify all your neighbors of lost and found pets. If all else fails, contact Richardson’s 24/7 Response center.

Does the HOA enforce picking up after dogs?

This issue is difficult to enforce due to the fact we need the pet owners name and address to do that. We are not in the community when this happens. Many times, when homeowner calls in with this violation, they do not have the name or address to send a violation. If they do the violation process listed above will be in effect.

Who do I call about broken sprinklers or water leaks in public areas?

Please notify Richardson’s 24/7 Response center at 972-744-4111 for public area that are not part of the Creek Hollow common areas. If the issue is with the Creek Hollow common area, then contact SpectrumAM at 972-992-3444.

How do I report a streetlight problem?

Streetlights are the responsibility the city. Contact Oncor to notify them of issues.

Can homeowners park cars in the street?

Yes, there is nothing in the governing documents prohibiting parking in the street. The City of Richardson enforces all street related issues.

Can the HOA documents be amended or updated?

Yes, but not easily. The Covenants impose rigid guidelines on how they can be changed. Section 7.5 of the Covenants describes the conditions for amendments. It states that two-thirds of the neighborhood must actively vote for the amendment. We have great difficulty getting a 10% representation in order to hold our Annual Meeting so an attempt to get two-thirds of the 576 homes to actively vote for a change requires a great deal of coordination and desire for a change.

7.5 Amendment. This Declaration may be amended or modified upon the express written consent of at least sixty-six and two-thirds percent (66-2/3%) of the outstanding votes (determined pursuant to Section 3.2 hereof) held by Members at a meeting at which a quorum is present. If the proposed amendment involves a modification of any of the Association’s agreements, covenants or restrictions pertaining to the use, maintenance, operation, maintenance and/or supervision of any Areas of Common Responsibilities, the approval of the City must also be obtained for such amendment. Any and all amendments, if any, shall be recorded in the office of the County Clerk of Collin County, Texas. Notwithstanding the foregoing, Declarant shall have the right to execute and record amendments to this Declaration with the consent or approval of any other party if the sole purpose of the amendment is for the purpose of correcting technical errors or for purposes of clarification.
